General Terms of Sale

These General Terms of Sale (hereinafter "GTS") govern the contractual relationship between BRONEER NEIL (hereinafter "Lummy", "we", "our") and any professional or individual customer (hereinafter "the Customer", "you") wishing to purchase credits or subscribe to a plan on the lummy.fr website.

These GTS complement and add to the General Terms of Use.

2. Scope of Application

These GTS apply to all sales of credits and subscriptions made on the lummy.fr website, whether the Customer is an individual (consumer) or a professional.

Placing an order implies full acceptance of these GTS. No particular condition may, except formal written acceptance on our part, prevail over these GTS.

We reserve the right to modify these GTS at any time. The applicable GTS are those in effect at the date of the order.

3. Offers and Pricing

3.1 Description of Offers

Lummy offers a credit system for generating product images. Available offers are detailed on the site's Pricing page and include:

  • Free offer: A limited number of credits offered upon registration
  • Credit packs: One-time credit purchase without commitment
  • Subscriptions: Recurring plans with monthly credit renewal

Each image generation consumes a certain number of credits depending on complexity and requested resolution. The required number of credits is indicated before each generation.

3.2 Pricing

Prices are indicated in euros (€) and include French VAT at the current rate. In accordance with micro-entrepreneur status, VAT is not applicable until legal thresholds are exceeded.

We reserve the right to modify our prices at any time. However:

  • Applicable prices are those in effect at the time of order
  • For current subscriptions, price changes will be communicated at least 30 days before their application
  • Already purchased credits remain usable under the conditions in effect at the time of purchase

4. Ordering and Payment

4.1 Order Process

To place an order, the Customer must:

  1. Select the desired credit pack or subscription
  2. Review the order summary (description, price, VAT)
  3. Accept these GTS by checking the provided box
  4. Proceed with payment via our secure provider Stripe
  5. Receive an order confirmation email

Final validation of the order by the Customer constitutes irrevocable acceptance and forms the sales contract.

4.2 Payment Methods

Payments are securely processed by our payment provider Stripe. Accepted payment methods are:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Apple Pay and Google Pay

Payment must be made immediately upon ordering. Credits will only be credited after payment confirmation by Stripe.

4.3 Payment Security

All transactions are secured and encrypted via SSL protocol. We do not store any banking data on our servers. Stripe is PCI-DSS level 1 certified, the highest security level in the payment industry.

4.4 Invoices

An invoice is automatically generated and sent by email after each purchase. Invoices are also accessible from your customer area.

5. Service Delivery

As the service is digital, delivery is instant:

  • Purchased credits are immediately credited to your account after payment confirmation
  • You receive a confirmation email containing your purchase summary
  • Credits are immediately available to generate images

6. Subscriptions

6.1 Operation

Subscriptions operate on a monthly automatic renewal model:

  • Payment is automatically charged each month on the subscription anniversary date
  • Monthly credits are added to your account at each renewal
  • Unused credits at the end of the month are generally not carried over (depending on the selected plan)

6.2 Subscription Cancellation

You can cancel your subscription at any time from your customer area. Cancellation will take effect at the end of the current billing period. No refund will be made for the already paid period.

To cancel:

  1. Log in to your customer area
  2. Access the "Subscriptions" section
  3. Click "Cancel subscription"
  4. Confirm your request

You will continue to benefit from your subscription until the end of the paid period.

6.3 Modification or Suspension

You can at any time:

  • Switch from one subscription plan to another (immediate change with pro-rata adjustment)
  • Temporarily suspend your subscription (subject to availability of this feature)

7. Right of Withdrawal

7.1 Digital Content - Waiver of Right of Withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium, the performance of which has begun with the prior express consent of the consumer and for which they have waived their right of withdrawal.

By validating your order and accepting these GTS, you:

  • Expressly accept that service execution begins immediately after payment validation
  • Expressly waive your right of withdrawal
  • Acknowledge that purchased credits are immediately made available and usable

7.2 Exceptions

In case of technical problems preventing service use or obvious non-conformity, you can contact us within 14 days to request a refund. Each request will be studied on a case-by-case basis.

8. Warranties and Liability

8.1 Conformity Warranty

We guarantee that the provided service conforms to the description presented on the site at the time of order.

8.2 Legal Warranty

For consumer customers, the following legal warranties apply:

  • Legal warranty of conformity (articles L217-4 to L217-14 of the French Consumer Code)
  • Legal warranty against hidden defects (articles 1641 to 1649 of the French Civil Code)

8.3 Limitations

The service is provided "as is". We do not guarantee:

  • That generated images will perfectly match your subjective expectations
  • Total absence of imperfections in AI-generated images
  • A specific commercial result from using the images

9. Credit Validity and Expiration

9.1 Credit Packs

Credits purchased in packs generally have unlimited validity, unless otherwise stated at purchase (promotional offers).

9.2 Subscription Credits

Monthly credits provided as part of a subscription may have a specific rollover policy depending on the plan:

  • Some plans allow rollover of unused credits
  • Other plans reset the counter each month

The applicable rollover policy is clearly indicated when subscribing.

9.3 Free Credits

Credits offered for free (promotion, referral, etc.) may have limited validity which will be specified when granted.

10. Refunds

Given the digital nature of the service and instant delivery, no refunds will be made, except:

  • Billing error on our part
  • Prolonged technical impossibility to use the service attributable to Lummy
  • Obvious non-conformity of the service compared to the description

12. Force Majeure

We shall not be held liable for any delay or failure to perform our obligations resulting from force majeure, as defined by French case law, including notably: natural disasters, fires, strikes, telecommunication network failures, cyber attacks, government decisions, etc.

13. Intellectual Property

Purchasing credits gives you the right to use the service to generate images, but does not grant you any rights to:

  • Lummy's source code, algorithms, or technology
  • Lummy's trademarks, logos, and graphic elements
  • The service concept and design

However, you own the images you generate (see the Terms of Use for more details).

14. Personal Data

Personal data collected as part of your purchases is processed in accordance with our Privacy Policy.

15. Consumer Mediation

In accordance with the provisions of the French Consumer Code concerning amicable dispute resolution, BRONEER NEIL subscribes to the FEVAD (French E-commerce and Distance Selling Federation) E-commerce Mediator Service, whose contact details are as follows:

After prior written approach by consumers to BRONEER NEIL, the Mediator Service can be contacted for any consumer dispute whose resolution has not been successful.

16. Applicable Law and Jurisdiction

These GTS are governed by French law.

Any dispute relating to their interpretation and/or execution falls under the jurisdiction of competent French courts.

In accordance with legal provisions, in case of dispute with a consumer, an amicable resolution will be sought before any legal action.

17. Language

These GTS are written in French. In case of translation, only the French version is legally binding.

18. Retention and Archiving

We archive orders and invoices in accordance with legal and tax obligations (minimum 10 years). Contractual communications are also archived under reasonable security conditions.
